On October 12th, 2026, the arrest of Elvin Rivera, age 57, was announced by Queens District Attorney Melinda Katz. Elvin Rivera was charged with second-degree Manslaughter, second-degree Vehicular Manslaughter, second-degree Assault, Operating a Motor Vehicle Under the Influence of Alcohol/Drugs, Driving While Ability Impaired by the Combined Influence of Drugs or of Alcohol and Any Drug, Reckless Driving, Driving by an Unlicensed Operator, and other unspecified charges. The arrest and charges against Elvin Rivera were a result of an investigation handled by the Queens District Attorney’s Office.
According to the Queens District Attorney’s Office, at approximately 8:35 a.m. on October 11th, 2026, Elvin Rivera was driving a white Chevrolet Silverado pickup truck heading northbound on Murray Street in the direction of 32nd Avenue. After the defendant rolled through the 32nd Avenue stop sign he continued to accelerate before allegedly hitting the victim, Justin Hu, who was being pushed in his stroller by his nanny. The child was swiftly taken to a local hospital where he was pronounced as deceased. The nanny had also sustained injuries to her right arm. Elvin Rivera was found stationed at the scene of the incident where both sobriety and drug tests were administered. These tests detected both THC and cocaine in Elvin Rivera’s system, in addition to the discovery of an open DWI case from April 2026 in the Bronx, New York.
The Queens District Attorney’s Office stated that the charges against Elvin Rivera are merely accusations, and the defendant is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law.
