On August 7th, 2026, the arrest of Jonathan Barbecho, age 30, was announced by Queens District Attorney Melinda Katz. Jonathan Barbecho was charged with first-degree Vehicular Assault, two counts of second-degree Assault, second-degree Manslaughter, second-degree Vehicular Manslaughter, Aggravated Vehicular Homicide, two counts of Leaving the Scene of an Incident Without Reporting, Operating a Motor Vehicle While Under the Influence of Alcohol, Reckless Driving, and other unspecified traffic violations. The arrest and charges against Jonathan Barbecho were a result of an investigation handled by the NYPD and the Queens District Attorney’s Office.
According to the Queens District Attorney’s Office, on December 31st, 2025, the defendant was amongst a group of people located outside a bar on 104th Street in Corona, New York. Jonathan Barbecho left the bar at approximately 4:00 a.m. on January 1st, 2026, and entered the driver’s seat of his Chevrolet Traverse SUV to drive two others from the group home. The defendant was allegedly driving southbound on 102nd Street at a high rate of speed. At the same time pedestrians Darwin Adrian Malan Cargua and Luis Paco Romero Gaucho were crossing at the intersection of 102nd Street and 37th Avenue. Jonathan Barbecho then allegedly struck both men and continued to speed off without stopping to render aid or call emergency services. The collision threw Darwin Adrian Malan Cargua under a nearby parked car and inflicted blunt force injuries to his head that led to him being declared deceased on the scene. Luis Paco Romero Gaucho was transported to a local hospital and after receiving multiple surgeries remains in a vegetative state. After the crash Jonathan Barbecho stopped his vehicle near the intersection of 39th Avenue and 103rd Street and refused to return to the scene of the collision. At this time the defendant parted ways from the two companions that were passengers.
The next day at approximately 4:00 a.m. Jonathan Barbecho boarded a flight to Ecuador leaving from Kennedy Airport. Investigators located the defendant’s vehicle parked near the airport with the front and back license plates removed and heavy front-end collision damage sustained. Jonathan Barbecho’s driver’s license was previously suspended following a prior arrest on April 13th, 2025, for operating a motor vehicle while under the influence of alcohol or drugs. It’s alleged that he was discovered while passed out in the driver’s seat of his car with the engine running at approximately 2:14 a.m. while double parked and partially blocking the intersection of 37th Avenue and Warren Street. An Intoxilyzer exam was administered that uncovered Jonathan Barbecho had a blood alcohol content of .106 at the time of this incident, which is above the legal limit of .08. A bench warrant was issued for the defendant’s arrest on January 23rd, 2026, as he failed to return to court on charges issued from the April 13th incident.
The Queens District Attorney’s Office stated that the charges against Jonathan Barbecho are merely accusations, and the defendant is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law.
