On July 16th, 2025, the arrest of Andre Cheeves, age 35, was announced by Manhattan District Attorney Alvin L. Bragg Jr.. Andre Cheeves was charged with second-degree Attempted Assault, second-degree Aggravated Harassment, second-degree Menacing as a Hate Crime, and third-degree Criminal Possession of a Weapon. The arrest and charges against Andre Cheeves were a result of an investigation handled by officers of the NYPD’s Transit District 4 and 1st Precinct.
According to the Attorney General’s Office, at approximately 1:30 a.m. on June 27th, 2025, both the victim and Andre Cheeves were present at the Fulton Station near the northbound 4 and 5 train platforms. Andre Cheeves allegedly approached the victim unprovoked while wielding a bike chain, and demanded the victim return his cellphone. The victim did not know who the defendant was, nor did he have his cellphone, and began to back away in fear. Allegedly Andre Cheeves became agitated at the victim and began to swing his bike chain like a weapon. The victim used his backpack to shield himself in self-defense. However, Andre Cheeves allegedly continued to attack the victim while yelling racist remarks all with anti-hispanic rhetoric. The victim was chased out of the subway station before nearby police were tracked down and flagged, leading to Andre Cheeve’s arrest and the recovery of the bike chain.
The Attorney General’s Office stated that the charges against Andre Cheeves are merely accusations, and the defendant is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law.
