Fairview, NJ resident Jose Francisco-Garcia was arrested and charged with Vehicular Homicide. The investigation into the case was led by the Bergen County Prosecutor’s Office and the Fairview Police Department.

On March 18, 2020, the Fairview Police Department responded to a motor vehicle accident on One Broad Avenue. When officers arrived at the scene, they discovered a 2017 Honda Civic that suffered serious damage from a head on collision with a utility pole. The driver, Jose Francisco-Garcia was seen outside of the vehicle and had suffered minor injuries. Jose Santos of North Bergen, NJ, was in the passenger’s seat and sustained fatal injuries.

After a thorough investigation conducted by the Bergen County Prosecutor’s Office Fatal Accident Investigation Unit and the Fairview Police Department, Jose Francisco-Garcia was arrested and charged with one count of Vehicular Homicide, in violation of N.J.S.A. 2C:11-5, a 2nd degree crime.

In addition, he was charged with the following motor vehicle violations: Driving While Intoxicated, in violation of N.J.S.A. 39:4-50; Reckless Driving, in violation of N.J.S.A. 39:4-96; and Failure To Maintain Lane, in violation of N.J.S.A. 39:488. Francisco-Garcia awaited his first appearance in Central Judicial Processing Court in Hackensack, NJ on March 30, 2020. The charges are accusations and the defendant will remain innocent until proven guilty. The Bergen County Prosecutors Office is under the supervision of Chief Robert Anzilotti. The Fairview Police Department is under the supervision of Chief Martin Kahn. The prosecution into the case will be led by Mark Musella.
