On January 29th, 2026, the arrest of Emiliano Davila, age 41, was announced by Ocean County Prosecutor Bradley D. Billhimer. Emiliano Davila was charged with Murder. The arrest and charges against Emiliano Davila were a result of an investigation handled by the Ocean County Prosecutor’s Office Major Crime Unit, Ocean County Prosecutor’s Office Narcotics Strike Force, Seaside Heights Police Department Detective Bureau, Toms River Township Police Department, Brick Township Police Department, Ocean County Sheriff’s Office Crime Scene Investigation Unit, and the Ocean County Medical Examiner’s Office.
According to the Ocean County Prosecutor’s Office, a report from Community Medical Center was made out to the Toms River Police Department about an unresponsive female with blunt force trauma to her head, brain bleeding, and bruising from strangulation. The victim was identified as 32-year-old Marry O’Connor and was reported to have been dropped off at the hospital by two unidentified men before they left the area. A subsequent investigation into the victim’s injuries pinned Emiliano Davila as one of the men that left her at Community Medical Center. It was revealed that Emaliano Davila and Marry O’Connor were in a dating relationship and were staying at a hotel in Seaside Heights, New Jersey, near her residence. When both individuals were in the defendant’s motel room it’s alleged that’s when he assaulted her, leading to Emiliano Davila initially being charged with Domestic Violence and Aggravated Assault by way of Strangulation. On November 5th, 2025, Marry O’Connor was pronounced dead after succumbing to her wounds, and a post-mortem examination on her body was done by the Ocean County Medical Examiner’s Office the following day. The examination determined that the manner of death was homicide from blunt force trauma to her head that caused a subdural hematoma. This subsequently caused the initial charges against Emiliano Davila were upgraded to the current Murder charge.
The Ocean County Prosecutor’s Office stated that the charges against Emiliano Davila are merely accusations, and the defendant is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law.
